A More Progressive Approach to Legal Representation

Noncustodial parents have many important rights

In the event that a Tennessee court determines that a child should be in the sole physical custody of one of their parents, the noncustodial parent may feel as though they have lost all possible opportunity to be involved in their child's life. However, this is not necessarily the case. Despite the fact that a child may not live in the same physical space as their noncustodial parent does not mean that that parent may be cut out of the child's life.

In Tennessee noncustodial parents can have many parental rights. For example, they must have minimum amounts of contact with their kids by telephone and must be able to receive other communications from their kids as well. Noncustodial parents must be allowed to attend academic and extracurricular activities involving their children and may not be subjected to the verbal disparaging of others when their children are nearby.

Noncustodial parents must be kept in the loop about where their children are and when they are facing difficulties. When a custodial parent plans to take a child out of state for longer than two days then the noncustodial parent must be notified, and when a child is hospitalized or suffers an emergency their noncustodial parent must be made aware of their condition.

Not having custody of one's child should not mean not having contact or communication with one's child. The rights of a noncustodial parent are important and should be protected. Without their enforcement, the relationship between a child and their noncustodial parent may suffer. Those who need help enforcing their noncustodial parental rights can get help from family law attorneys who are familiar with their cases.
