What is a second parent adoption?

When a same sex couple decides to have a child, it is often the case that one of the individuals will have a biological link to the child. When that child is born the child will be considered the child of that parent as the individual contributed to the child's genetic make-up. However, the other individual in the couple may not be considered a parent since they are not related biologically to the youth.

Tennessee couples facing this dilemma may look to adoption to remedy this issue. It seems as though the partner of the child's biological parent could seek to adopt the child and make them their own through legal channels; in jurisdictions throughout the country this is known as second parent adoption.

However, second parent adoption is not recognized in all states and in Tennessee the law is not explicitly settled. The marital status of a same sex couple may influence whether one partner is allowed to adopt the child of their significant other; in some jurisdictions, marriage or the presence of a domestic partnership is required to pursue second parent adoption.

Same sex couples can face many issues when they attempt to navigate the family law courts of Tennessee.
